General Information (Dealer & Non-Dealer)
Red Light: "As Is" Sold without guarantee of any kind.
Yellow Light: "Caution" Listen to announcements.
Green Light: "Ride & Drive" Sound Engine, Transmission, Rear-End, Drive-Train within $400.
Blue Light: "Title Absent" Vehicle sold without title present on sale night.
"Ifs" or "Conditional Sales" the Auction may sell a vehicle on a Conditional Sale. Buyers must sign the Bill of Sale at the Auction block and must wait at least thirty (30) minutes while the acceptance or denial is directed. Some Conditional Sales may not be confirmed or denied until the following day. Buyers are not obligated to wait past thirty (30) minutes. unless they choose to. Once you "Ride & Drive", "Okay to Pay", pay for and drive a vehicle out, it is yours. The only possible exceptions for Return are those units diagnosed by the Arbitrator as units with odometer discrepancies, undisclosed salvage histories, frame or flood damage. These problems must be reported and the unit returned to the Auction within 7 days of purchase. Day of sale is 1 day. No exceptions.
TEST DRIVE: You must first be the successful bidder of a unit that sells "Ride & Drive". Dealers and Non-Dealers have one hour after the sale of the unit to test drive. Dealers deliver your copy of the bill of sale to the guard prior to the drive. Retrieve your copy upon drive completion. Non-Dealers will have provided drivers license before test-drive and must drive on Auto Auction property. Even if vehicle sells "Title Absent", or with an "If" vehicle must be test driven on sale night. No Exceptions. Only visit Arbitration if the unit has a mechanical problem. Do not remove keys from purchased units. Units left longer than 10 days after notification of title arrival shall be charged $10 per day storage charge. Dealers and Non-Dealers must comply with all state and federal laws. Auction has the discretion to refuse service to anyone. All vehicles consigned to Auction are at the owner's risk. Auction is not responsible for theft, fire or damage to any units or any damage caused by an act of God. Auction provides a facility for the buying and selling of vehicles. This Auction makes no warranties implied or expressed. All representations are those of the seller.
Non-Dealers: Policies for Buying
Non-Dealers May NOT remove vehicles until title and monies are produced. Listen to ALL announcements, prior to sale, during sale, and read the auction policies.

Register to bid by depositing $300 CASH at Customer Service ($300 per unit bid on) and presenting valid U.S. driver's license.

The name and address in which you register will be the name and address to appear on your title if you are a successful buyer.

When you register, please provide accurate identification with an updated address and dytime telephone number.

A $50 fee will be assessed if you request any changes in name and address after registration.

Non-Dealers & Dealers must abide by Auction policies an sign agreement stating that fact.

The Auction cannot provide temporary tags. The Bill of Sale is provided as proof of ownership until buyer fulfills obligation by finalizing the transfer transaction AS SOON AS POSSIBLE or within 2 days at their county clerk or DMV. At that time purchaser will pay fees for transfer, tax and tag.

All vehicles sold $1,500 and under are AS IS, no matter what the announcement.

After final bid of the vehicle, you may pay sale night or by Tuesday afternoon to tender the amount due. If you do not tender the amount due by Tuesday, you forfeit the $300.

To Arbitrate a vehicle, the following requirements must be met: a.) Vehicle must have sold for over $1,500 under the Green Light. b.) Vehicle must be found to have defects of motor, transmission, rear-end or drive-train over $400 repair cost, individually (to be determined by the Arbitrator). c.) Arbitrator must be made aware of the problem within one (1) hour of purchase on sale night. d.) Vehicle can not be turned down for check engine or service engine light. ABS or Airbag lights are subject to turn down.

All Boats, Motorcycles, ATV'S, Tractors, ETC. sell AS IS.

Non-Dealers will be charged a buyer fee of $150.

If Registrant is an unsuccessful bidder, the $300 CASH deposit is refunded.

If Non-Dealer purchases a vehicle "Title Absent", purchaser cannot remove vehicle from premises until the title is produced to the Auction. The Auction will phone the buyer AS SOON AS TITLE IS PRESENTED TO THE AUCTION. Do not call the Auction or the seller the Auction will phone you immediately. The buyer should receive title on or before 30 days; if title is not produced, the buyer is entitled to be refunded the sles price + the buy fee.

If you are a successful bidder, it is advisable that you do not spend money on the vehicle until you receive a new title with your name from your state.
Non-Dealers: Policies for Selling

$20 non-refindable registration fee per unit registered.

Title to vehicle must be presented to Auction personnel at time of registration. The name on the title must be the person representing the unit. Photo ID required. (NO OPEN TITLES).

Owner must represent vehicle(s) honestly.

All frame, flood, hail damage, broken odometer, previous salvage, taxi, police, etc. MUST BE ANNOUNCED.

If a vehicle is returned, the seller is responsible for buy and sell fees.

Any seller not providing a transferable title on a sold unit will be charged a "Title Absent" fee. As a seller, it is your responsibility to ensure that title is free of any encumbrance or liens and clear for transfer.

All taxes must be paid on the vehicle.

Liens must be released on the face of the title (if KY or TN) or in accordance with the state law of the titled state.

Vehicles selling will be charged a flat $125 sellers fee. Fees are deducted from seller's sales check.

The Auction is not responsible for antifreeze and other fluids-this is the responsibility of the seller.

Absolutely no vehicle will sell without a VIN plate.

Those units sold "AS IS" cannot be rejected for a defect.
Policies for Dealers:

Pay with Company Check or Cash on sale night. Method of payment subject to Auction approval.

Signing "OK to Pay" enables Auction to speed paperwork at end of sale; this is your legal promise to pay for the vehicle.

All sellers must represent units honestly.

All frame, flood, hail damage, broken odometer, previous salvage, rebuilt, taxi, police, no air bag, ABS, must be announced. Sellers are liable for vehicles with tampered odometers, whether directly or indirectly involved.

If in 30 days title is not produced on a "Title Absent" transaction, the buyer is entitled to a refund of total purchase price. If a vehicle is returned for misrepresentation or no title, the seller is responsible for buy and sell fee.

Any seller not providing a transferable title on a sold unit will be charged a title attached fee. As a Seller, it is your responsibility to ensure that title is negotiable in the buyer's state. Titles must be correctly assigned by dealers, and dealer assigned by Kentucky Dealers.

Kentucky selling dealers are responsible for all property tax on vehicles sold through Auction.

Please remove vehicles from lot within 7 days.
